These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", "your") and Datnass Tech Pvt Ltd ("Datnass", "we", "us", "our"), governing your access to and use of our cloud storage services, including GDX Cloud, GDX OnPrem, and related websites, applications, and services (collectively, the "Services").
By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our Services.

Acceptance of Terms
By creating an account, accessing, or using our Services, you confirm that:
- You are at least 18 years of age or have reached the age of majority in your jurisdiction
- You have the legal authority to enter into these Terms on behalf of yourself or the organization you represent
- You have read and understood our Privacy Policy and consent to the processing of your personal data as described therein
- You agree to comply with all applicable laws and regulations in connection with your use of the Services
If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and "you" and "your" shall refer to that organization.
Description of Services
Datnass provides S3-compatible object storage solutions designed for businesses of all sizes:
GDX Cloud
Our cloud-hosted object storage service offering:
- S3-compatible object storage with flexible pricing plans
- Geo-redundant storage across multiple datacenters
- Zero-knowledge encryption at rest and in transit
- Free data ingress with generous egress allowance
- No API request charges or delete charges
- Web console and S3-compatible API access
GDX OnPrem
Our on-premises object storage solution offering:
- Self-hosted S3-compatible object storage on your infrastructure
- Complete data sovereignty and control
- Available in self-managed, co-managed, or fully managed options
- Support for heterogeneous platforms (x86 and arm64 architectures)
- Compliance with data residency requirements
- Enterprise support and custom deployment services
Additional features for both services include custom domain support, data fragmentation and distribution, and integration with existing S3-compatible tools and applications. The specific features, storage limits, and pricing for each service are as described on our website and in your service agreement. We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time with 30 days' prior notice.
Account Registration & Security
Account Creation
To use our Services, you must create an account by providing accurate, complete, and current information. You agree to:
- Provide truthful and accurate registration information
- Maintain and promptly update your account information
- Not create accounts using false identities or on behalf of others without authorization
- Not create multiple accounts to circumvent service limits or restrictions
Account Security
You are responsible for maintaining the security of your account:
- Keep your login credentials confidential and secure
- Use strong, unique passwords for your account
- Notify us immediately at hello@datnass.com if you suspect unauthorized access
- You are responsible for all activities that occur under your account
API Keys and Access Credentials
If you use API keys or access credentials to access the Services:
- Treat all API keys and access credentials as confidential
- Do not share credentials in public repositories, forums, or unsecured locations
- Rotate credentials regularly and revoke any compromised keys immediately
- We are not liable for any unauthorized use resulting from your failure to secure credentials
Payment Terms
Pricing and Fees
- Current pricing is available on our GDX Cloud pricing page and GDX OnPrem pricing page
- Prices are quoted in Indian Rupees (INR) unless otherwise specified
- All fees are exclusive of applicable taxes (GST), which will be added where required
- We reserve the right to change pricing with 30 days' prior notice
Billing and Payment
- Mini Storage Plans: Billed monthly in advance (100GB, 200GB, or 500GB options)
- Reserved Storage Plan: Billed annually in advance (minimum 1TB at ₹16,000/TB/year)
- Enterprise Storage Plan: Custom pricing and billing terms
- GDX OnPrem: Custom pricing based on deployment requirements
- Payment is due within 15 days of invoice date unless otherwise agreed
- We accept payment via credit/debit cards, UPI, net banking, and bank transfers
Late Payments
- Overdue payments may incur interest at 1.5% per month
- We may suspend Services for accounts with outstanding payments exceeding 30 days
- Suspended accounts may be reactivated upon full payment of outstanding amounts
- Data may be deleted from accounts suspended for more than 90 days
Free Trial
- We offer a 15-day free trial for GDX Cloud with no credit card required
- Trial accounts have access to all standard features
- You may upgrade to a paid plan at any time during or after the trial period
Data Transfer Charges
- Ingress (Upload): Free - no charges for uploading data
- Egress (Download): Free up to 2x your active storage capacity
- Additional Egress: ₹1.25/GB beyond the free allowance
- API Requests: No charges for API operations
- Delete Operations: No charges for deleting data
Refunds
- Subscription fees are non-refundable except as required by law
- Service credits may be issued in accordance with our Service Level Agreement
- Refund requests must be submitted within 7 days of the billing date
Acceptable Use Policy
You agree to use our Services only for lawful purposes. You shall NOT use the Services to store, distribute, or transmit:
Prohibited Content
- Content that violates any applicable law or regulation
- Content that infringes on intellectual property rights of others
- Malware, viruses, or other malicious code
- Content promoting violence, terrorism, or illegal activities
- Child sexual abuse material (CSAM) or exploitation content
- Content that is defamatory, obscene, or constitutes harassment
- Unauthorized personal data of third parties
- Content that violates export control laws
Prohibited Activities
- Attempting to gain unauthorized access to our systems or other users' accounts
- Interfering with or disrupting the Services or servers
- Using the Services for cryptocurrency mining without authorization
- Reselling or redistributing the Services without written permission
- Circumventing usage limits, quotas, or security measures
- Using automated systems to abuse or overload the Services
- Sending spam or unsolicited communications using our Services
Enforcement: We reserve the right to investigate violations and take appropriate action, including warning, suspension, or termination of your account, and reporting illegal activities to law enforcement authorities.
Your Data & Content
Ownership
You retain all rights, title, and interest in and to any data, files, or content you upload to the Services ("Your Content"). Datnass does not claim any ownership rights over Your Content.
License Grant
By uploading Your Content to the Services, you grant Datnass a limited, non-exclusive license to:
- Store, process, and transmit Your Content solely to provide the Services
- Create backups and replicas for redundancy and disaster recovery
- Perform technical operations necessary for service delivery
This license terminates when you delete Your Content or close your account.
Your Responsibilities
- You are solely responsible for Your Content and its legality
- Ensure you have all necessary rights to upload and use Your Content
- Maintain your own backups of critical data
- Comply with all applicable data protection laws when storing personal data
Data Processing and Security
When you use our Services to store personal data of third parties, you act as the data fiduciary, and Datnass acts as your data processor. Key security features include:
- Zero-Knowledge Encryption: Your data is encrypted before leaving your system
- Data Fragmentation: Files are split into encrypted pieces before distribution
- Geo-Distribution: Data fragments are stored across multiple datacenters
- No Complete Files: No single location contains your complete unencrypted data
A Data Processing Agreement (DPA) is available upon request for enterprise customers requiring compliance documentation.
Intellectual Property
Datnass IP
All intellectual property rights in the Services, including but not limited to:
- The Datnass name, logo, and branding
- GDX Cloud and GDX OnPrem trademarks
- Software, code, and technical implementations
- Documentation, designs, and user interfaces
- APIs and related specifications
are and remain the exclusive property of Datnass Tech Pvt Ltd. These Terms do not grant you any rights to use our trademarks or branding without prior written consent.
Feedback
If you provide us with feedback, suggestions, or ideas regarding the Services, you grant us a perpetual, irrevocable, royalty-free license to use such feedback for any purpose without obligation to you.
Disclaimers & Limitations of Liability
Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability or fitness for a particular purpose
- Warranties of non-infringement
- Warranties that the Services will be uninterrupted, error-free, or secure
- Warranties regarding the accuracy or reliability of any information obtained through the Services
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Datnass shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- Datnass shall not be liable for any loss of data, profits, revenue, or business opportunities
- Our total liability for any claims arising from these Terms or the Services shall not exceed the fees paid by you in the 12 months preceding the claim
Indemnification
You agree to indemnify, defend, and hold harmless Datnass, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your use of the Services
- Your Content or its use
- Your violation of these Terms
- Your violation of any third-party rights
Termination
Termination by You
You may terminate your account at any time by:
- Contacting us at hello@datnass.com
- Using the account deletion option in your account settings (where available)
Upon termination, you remain responsible for any outstanding fees, and prepaid fees are non-refundable.
Termination by Datnass
We may suspend or terminate your account:
- For Cause: Immediately upon violation of these Terms, the Acceptable Use Policy, or applicable law
- For Non-Payment: After 30 days of overdue payment
- For Convenience: With 30 days' prior written notice
Effect of Termination
- Your right to access the Services will immediately cease
- We will retain Your Content for 30 days to allow data export
- After 30 days, Your Content may be permanently deleted
- Sections relating to intellectual property, limitations of liability, indemnification, and governing law survive termination
Governing Law & Dispute Resolution
Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
Dispute Resolution
In the event of any dispute arising out of or relating to these Terms:
- Informal Resolution: We encourage you to contact us first at hello@datnass.com to attempt informal resolution
- Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 of India
- Jurisdiction: The arbitration shall be conducted in Anand, Gujarat, India
- Language: The arbitration proceedings shall be conducted in English
Class Action Waiver
To the extent permitted by law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
Changes to These Terms
We may update these Terms from time to time to reflect changes in our Services, legal requirements, or business practices.
- Material changes will be notified at least 30 days in advance via email or notice on our website
- Non-material changes may be made at any time and will be effective upon posting
- Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms
- If you do not agree to the revised Terms, you must stop using the Services and terminate your account
The "Last Updated" date at the top of this page indicates when these Terms were last revised.
